GENERAL TERMS

1. General Provisions

HalPet d.o.o., Zagreb, Janka Rakuše 1 (hereinafter: HalPet), provides consulting services, organizes and conducts business training sessions and workshops, engages in knowledge transfer, and manages the LPC e-learning platform and web shop at the internet addresses lpc.halpet.eu and halpet.hr (hereinafter: the Websites).

By accessing and using the Websites, users confirm that they are familiar with, understand, and fully accept these Terms of Use, and agree to use the Websites in accordance with them. The right to use the Websites is non-transferable. Users are responsible for keeping their passwords and access credentials confidential.

HalPet shall not be liable for temporary unavailability, interruptions, or limitations of services caused by maintenance, technical issues, force majeure, or other causes beyond HalPet’s control. All information on the Websites is subject to change without prior notice; HalPet may, at any time, modify the content, structure, or availability of the Websites or discontinue them entirely.

2. Amendments to the Terms of Use

HalPet reserves the right to amend these Terms of Use and related policies at any time; amendments take effect upon publication on the Websites. Continued use of the Websites after such publication constitutes acceptance of the amended Terms. Users are required to periodically review the Terms of Use to stay informed of possible changes. HalPet shall not be liable for any damages arising from such amendments if they have been duly published on the Websites.

3. Computer Equipment and Access Costs

The user is solely responsible for acquiring, installing, updating, and maintaining their own computer equipment, software, and internet connection necessary for accessing and using the Websites, as well as for all related costs (e.g., telephone charges, data transfer fees, etc.). HalPet shall not be liable for any damage to the user’s equipment resulting from the use of the Websites.

4. User Conduct

Users must use the Websites in accordance with these Terms and the applicable laws of the Republic of Croatia.
It is prohibited to post, transmit, send, or make available any content that is unlawful, offensive, defamatory, racist, threatening, pornographic, harmful, or that infringes upon the privacy or intellectual property rights of others, or that incites illegal behavior.
Unauthorized advertising, spam, or other promotional activities without HalPet’s written consent are strictly prohibited.
HalPet reserves the right to temporarily or permanently restrict access to, or terminate, user accounts that violate these Terms.
Users must use the Websites in a manner that does not endanger their security, availability, or functionality and must not attempt to gain unauthorized access to systems, databases, administrative areas, or other users’ accounts.

5. Intellectual Property

All content available on the Websites (including but not limited to texts, photos, graphics, videos, audio recordings, interface design, databases, and software) is protected by copyright and other intellectual property rights owned by HalPet. All rights are expressly reserved.
Use, copying, reproduction, distribution, modification, public display, or any commercial exploitation of the content without HalPet’s prior written consent is strictly prohibited.
Users may download or print materials solely for their own internal, non-commercial, and informational purposes.
If a user publishes content in the publicly accessible parts of the Websites, they guarantee that they hold the rights to such content and grant HalPet a free, perpetual, and non-exclusive right to use that content for the purpose of providing and promoting services (e.g., displaying or reproducing it on the platform), in accordance with applicable laws.

6. Licenses and Trademarks

By using the Websites, users do not acquire any rights to HalPet’s trademarks, patents, designs, copyrights, or other intellectual property. All rights related to HalPet’s identity and marks are reserved.

7. Disclaimer of Warranties and Limitation of Liability

Use of the Websites and all related services is entirely at the user’s own risk.
HalPet does not guarantee uninterrupted or error-free operation of the Websites, nor the complete absence of inaccuracies in their content.
HalPet shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Websites, including but not limited to loss of data, lost profits, business interruption, or damage to equipment or software, even if HalPet has been advised of the possibility of such damages.
HalPet reserves the right to suspend or terminate user accounts in the event of misuse or violation of these Terms.
Nothing in these Terms shall exclude or limit HalPet’s liability for obligations that cannot be excluded under applicable law, including consumer rights under the Consumer Protection Act.

8. Monitoring and Removal of Content

HalPet reserves the right, but not the obligation, to monitor public content posted on the Websites (comments, forums, reviews, etc.) to ensure compliance with these Terms. HalPet may remove or disable access to any content deemed inappropriate or harmful without prior notice.

9. Privacy and Data Protection

HalPet processes users’ personal data in accordance with the applicable laws of the Republic of Croatia and the General Data Protection Regulation (GDPR).
Personal data is collected and used solely for the purpose of providing services (e.g., managing user accounts, administering programs, fulfilling web shop orders, and communicating regarding services) and for other purposes for which users have given explicit consent (e.g., receiving promotional messages).
Access to personal data is limited to authorized HalPet personnel who need it to perform their duties; data is not shared or transferred to other organizations except where legally required or explicitly consented to by the user.
Users have the right to access, rectify, delete, restrict processing, and transfer their data, as well as the right to object to processing and withdraw consent for future processing. To exercise these rights, users may contact: halpet@halpet.hr.
HalPet implements technical and organizational measures to protect personal data (e.g., access control, secured systems, encryption where appropriate). More detailed information is provided in the Privacy Policy available on the Websites.

10. Indemnification

The user agrees to indemnify HalPet, its employees, and authorized representatives against all claims, costs, and damages (including reasonable legal fees) arising from any violation of these Terms or unlawful use of the Websites.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

12. Waiver

The failure of HalPet to exercise any right under these Terms shall not constitute a waiver of such right or limit HalPet’s right to take action at a later time.

13. Dispute Resolution and Jurisdiction

These Terms are governed by the substantive laws of the Republic of Croatia. The parties will seek to resolve all disputes arising from the application of these Terms amicably. If an amicable settlement is not possible, the competent court in Zagreb shall have exclusive jurisdiction.

14. Applicability of the Terms

These Terms of Use take effect upon publication on the Websites and remain valid until amended or revoked by HalPet. Users are encouraged to periodically check for updates to stay informed.
